If, as a fellow delegate (I’ve served as a state or county delegate over a dozen times, and as precinct chair or vice-chair a half a dozen times), you hate SB-54 as much as I do, I’ve got good news for you – I can likely have it declared unconstitutional by June 28, primary day, this summer. You see SB-54 is blatantly unconstitutional in that a state legislature passed a law dictating to a private political party, who gets to appear on their primary ballot. Not only is it unconstitutional, but prone to gross abuse, since David Duke could quickly establish residency in Utah, and with an army of clean cut volunteers gathering signatures statewide, while paying professionals signature gatherers just $7 to $10 per signature, easily appear on Utah’s Republican Primary Ballot for the U.S. Senate.

What’s wrong with that? David Duke is the former head of the KKK, and candidate for the American Nazi Party. How would that look for the Utah Republican party, The State of Utah, or the Church most associated with the State of Utah? Yet this is just as possible as Becky Edwards, a very left leaning candidate, entirely out of step with Utah’s conservative Republican Party and its delegates – appearing on the Republican Primary ballot on June 28th, which she is on schedule to do.

How can I keep these current, future and other SB-54 atrocities that happened in the past (such as Spencer Cox representing the Republican Party for Governor instead of Greg Hughs, or John Curtis representing the Republican Party for Congress just a few years after he served as the Chairman of the Utah County Democrat Party) from reoccurring?

Well since Mike Lee, Becky Edwards, and Ally Isom, have all decided to gather SB-54 signatures, instead of trusting the delegates to do the job they were elected to do at their precinct caucasus, and Mike Lee, Becky Edwards, and Ally Isom, are going to appear in the Republican Primary ballot no matter who the elected delegates vote for… why not vote for a candidate who will use his Standing as the the only candidate chosen by the Republican delegates to represent the Republican Party to challenge SB-54 in court – this time with STANDING

The only reason the The U.S. Supreme Court rejected hearing the suit brought against SB-54 by Keep My Voice, and the Utah Republican Party Constitutional Defense Committee in 2019, was the Supreme court stated they lacked STANDING. In other words they weren’t directly affected, or wronged by it.

If 60% of the delegates vote for a true and aggressive constitutional conservative such as myself at convention, that would make me the sole legitimate Republican candidate for the U.S. Senate representing the Republican Party. As such I should not, by party rules, have to participate in, or face any other challengers in a Republican Primary. Lawyers I’ve spoken with, including some who have argued before the Supreme court, strongly believe as the sole legitimate candidate of the Republican Party, forced to enter a primary race only because of SB-54, I would have STANDING.

I would use that STANDING to demand a rehearing of the challenge to SB-54 directly to the U.S. Supreme Court, based on the new facts that I have STANDING to present, The challenge to SB-54 has already gone through the appellate process up to the U.S. Supreme Court, and a ruling is exigent, since the unconstitutionally forced Primary is due to be held on June 28th.

What is the worst that can happen?

One, I lose my challenge. Mike Lee is embarrassed at the convention, but still in the primary. However, he and all other Republican candidates learn there is a price to pay by using SB-54 to go around the caucus process and the will of the delegates. Mike Lee very likely still wins the primary.

Two, I win my challenge, however the Supreme Court chooses not to apply it post facto. SB-54 is dead for all future races in Utah, but the Supreme Court allows the June 23rd primary to proceed with candidates based on signature gathering for this last election cycle only. Mike Lee is again very likely to win the primary.

Three, I win my challenge outright. No more SB-54, no other SB-54 signature candidates who didn’t get through their conventions get to participate in primaries either. Mike Lee gets to rest at home for two years before challenging Mitt Romney in 2024. Utah gets to be represented in the U.S. Senate by a true and aggressive constitutional conservative.

Seems like a Win vs Win situation to me. as a delegate, to cast your vote for me, as a candidate, at the State Republican Convention April 23rd.
